By signing a service agreement, submitting a registration form, or checking an onboarding authorization box, you ("Client," "you") agree to be strictly bound by these Terms.

ONE: 14-Day Free Trial Period We offer a 14-day trial of our lead generation systems starting exactly on the date your account registration is processed ("Trial Period"). No management fees or monthly retainer fees will be charged during these initial 14 calendar days. Trial Continuity Conditions: To maintain access to the trial and qualify for standard account setup, the Client must: (1) Provide all requested business onboarding digital assets (logos, phone numbers, location access) within the first 5 days of sign-up; (2) Keep their tracking or phone routing lines active during standard business hours; and (3) Attend or complete the initial launch onboarding strategy call. Exclusions: This 14-day trial applies strictly to [ Auto Mobile Leads ]'s core monthly management/retainer fees. All auxiliary costs and third-party operational expenses incurred during the Trial Period, including but not limited to direct Google Ads traffic spend, custom domain registration costs, or Twilio/LC Phone SMS usage fees, will be funded and taken care of by us. Cancellation and Billing: To avoid being charged, a written cancellation request must be submitted via email to: [ [email protected] ] Before 11:59 PM CST on the 14th calendar day following registration. If no cancellation request is received before the Trial Period expires, the Client's payment method on file will automatically be charged the standard monthly management fee.

TWO: No Guarantees on Ad Performance & Revenue

Client explicitly acknowledges that [ Mobile Auto Leads ] controls ad optimization, layout patterns, and structural deployment, but does not control external market variables, consumer demand, weather events, emergency service volume, or Google’s shifting auction algorithms.

We do not guarantee a specific number of incoming phone calls, vehicle repair leads, total closed sales, or net business revenue.

All marketing Services are delivered on an "as-is" and "as-available" framework.

THREE: Limitation of Liability (Legal Shield)

To the maximum extent permitted by applicable law, in no event shall [ Mobile Auto Leads ], its owners, officers, or platform partners be held liable for any indirect, incidental, special, exemplary, punitive, or consequential damages whatsoever. This includes, without limitation, damages for loss of business profits, service interruptions, truck downtime, mobile mechanic dispatch errors, data leaks, or unreturned client voicemails arising out of or in connection with the use of our Services.

The Ultimate Cap: Our absolute maximum aggregate liability for any legal claim, dispute, or lawsuit brought against us shall never exceed the total dollar amount explicitly paid by you to us for management services during the single (1) month immediately preceding the event giving rise to the claim.

FOUR: Client Indemnification

You agree to defend, indemnify, and hold completely harmless [ Mobile Auto Leads ] from and against any and all legal claims, damages, obligations, losses, liabilities, costs, or debt expenses (including reasonable attorney fees) resulting from or arising out of: (1) Your mobile mechanic field services, operational work quality, or customer safety disputes; (2) Violations of local business licensing, automotive repair compliance laws, or TCPA/SMS text messaging rules due to your business practices; or (3) Defamatory or incorrect statements provided by you for our ad creative configurations.

FIVE: Governing Law & Dispute Resolution

These Terms and all business interactions shall be governed by, interpreted, and enforced strictly in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any legal dispute, controversy, or claim arising out of this relationship that cannot be settled amicably shall be settled exclusively through binding arbitration in San Antonio, Texas, and you waive any right to pursue a class-action lawsuit or trial by jury.

Consent Gathering: Mobile phone numbers provided via online submission widgets, call-tracking paths, or opt-in boxes are collected strictly to execute the explicit service requested.

No Sharing: Consumer mobile phone numbers and explicit text messaging consent markers are strictly prohibited from being shared, leaked, or transferred to third-party affiliates or unlinked networks for promotional, cross-marketing, or advertising pipelines.
